Biography

Short Description

Burchard of Worms was a German bishop and canonist of the Ottonian and early Salian period, whose collection of ecclesiastical law became one of the most widely used legal handbooks of the Western Church in the eleventh century. He was born in the mid-tenth century into a noble family of Hesse, in the German kingdom of the Ottonian rulers; the exact year and place of his birth are not recorded in surviving sources. After the death of his parents he received a clerical education. He studied at the Benedictine abbey of Lobbes in the diocese of Liège, a distinguished school of the tenth century, and was formed in the scriptures, the liberal arts, and the canons. He subsequently served as a cathedral canon, was associated with the church of Worms, and rose to be provost of the cathedral chapter. In the year 1000 Emperor Otto III appointed him bishop of Worms; he was consecrated the same year and governed the see until his death.

As bishop, Burchard undertook the restoration of a city and diocese that had been damaged by invasion and neglect. He rebuilt the walls of Worms, promoted the reconstruction of the cathedral church of St. Peter, founded or restored other churches including the collegiate foundation of St. Paul, and laid out a new urban settlement beside the older town. He also issued a written law for the dependents of the church of Worms, the Lex familiae Wormatiensis ecclesiae, compiled near the end of his life. This customal regulated the status, duties, and legal procedures of the familia of the church—serfs, ministeriales, and other persons under episcopal lordship—and is an important document for the social history of the imperial church in the early eleventh century. Burchard took part in the synods and political assemblies of the realm under Emperor Henry II and was regarded as a reforming prelate concerned with clerical discipline and the administration of justice.

Burchard’s principal literary work is the Decretum, also known as the Collectarium canonum or Decretorum libri viginti, a systematic compilation of canon law in twenty books. It was assembled in the early years of the eleventh century, traditionally dated to about 1008–1012, with the help of collaborators including Bishop Walter of Speyer and Olbert of Gembloux. The collection draws on a wide range of earlier sources: conciliar canons, papal decretals (including the False Decretals), penitentials, excerpts from the Church Fathers, and earlier systematic collections such as the Collectio Anselmo dedicata. The books are arranged by subject and treat the ecclesiastical hierarchy, the sacraments, penance, marriage and sexual morality, monastic life, magic and superstition, homicide, theft, and many other topics of pastoral and judicial concern. Book Nineteen, often called the Corrector sive Medicus, is a lengthy penitential that lists sins and assigned penances and is a valuable source for popular belief and practice. The Decretum was intended as a practical manual for bishops and clergy rather than as a purely academic treatise. It circulated in numerous manuscripts across Germany, France, and Italy during the eleventh and early twelfth centuries and influenced later compilers, notably Ivo of Chartres; its material passed in part into the Decretum of Gratian in the mid-twelfth century.

Burchard died at Worms on 20 August 1025 and was buried in his cathedral. A life of the bishop, the Vita Burchardi, was written soon afterwards by a cleric of Worms and remains the chief narrative source for his career. In the local tradition of the diocese he was remembered with honour and has sometimes been venerated as a saint, with a commemoration on the day of his death, though he was not the subject of a formal papal canonization of the later medieval kind. His reputation in subsequent centuries has rested less on cult than on the enduring importance of his legal collection, which stands among the major monuments of pre-Gratian canon law and of the Ottonian imperial church.
